Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Records Desk application and related services (the “Service”) provided by Computer Code Blue, LLC (“Company,” “we,” “our,” or “us”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.
1. Eligibility & Accounts
- You must be legally capable of entering into a binding agreement to use the Service.
- You are responsible for the confidentiality of your account credentials and for all activities under your account.
- You must promptly notify us of any unauthorized use of your account.
2. Acceptable Use
You agree not to, and will not permit others to:
- Use the Service in violation of applicable law or to infringe the rights of others.
- Upload, transmit, or store malicious code, unlawful content, or content you lack the rights to share.
- Attempt to access the Service or related systems without authorization, or interfere with their operation.
- Reverse engineer, decompile, or otherwise attempt to derive source code except to the extent permitted by law.
3. User Content & Records Submissions
- You are responsible for the accuracy, legality, and appropriateness of content and data you submit, including records requests and responses.
- You grant us the rights necessary to process and display your submissions for the purpose of operating the Service.
- We may remove or disable content that violates these Terms or applicable law.
4. Privacy
Our collection and use of personal information is described in our Privacy Policy.
5. Service Availability & Modifications
We may modify, suspend, or discontinue the Service (in whole or part) at any time with or without notice. We are not liable for any unavailability or modification of the Service.
6. Fees & Payments (If Applicable)
If your plan includes fees, you agree to pay all charges according to the pricing and payment terms presented at the time of purchase or in an order form. Fees are non-refundable except as required by law or expressly stated otherwise.
7. Intellectual Property
The Service, including software, designs, logos, and content provided by us, is owned by or licensed to the Company and is protected by intellectual property laws. Except for rights expressly granted to you, we reserve all rights.
8. Feedback
If you provide feedback or suggestions, you grant us a non-exclusive, perpetual, irrevocable, royalty-free license to use and exploit such feedback for any purpose.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL COMPANY BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO USE THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.
11. Indemnification
You agree to defend, indemnify, and hold harmless Company and our affiliates, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses arising out of or related to your content, your use of the Service, or your violation of these Terms or applicable law.
12. Termination
We may suspend or terminate your access to the Service at any time for any reason, including if we believe you have violated these Terms. Upon termination, sections intended to survive will continue in effect.
13. Governing Law & Venue
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction and venue of the state or federal courts located in McHenry County, Illinois.
14. Export & Compliance
You represent that you are not located in a country subject to U.S. embargo and are not on any U.S. government restricted party list. You agree to comply with applicable export, sanctions, and anti-corruption laws.
15. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms with a revised effective date. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
